PRIVACY POLICY AND PERSONAL DATA PROTECTION


What are cookies and what are they used for?


Cookies are, in particular, text files stored on users’ end devices such as computers, mobile phones, or tablets. They allow the identification of the user’s device and proper display of the website (in the correct format and manner depending, for example, on the device used to browse the site). They contain the name of the website they come from, the storage time on the user’s device, and a unique number.

What types of cookies do we use?
We use two types of cookies: session and permanent. Session cookies are temporary and remain on the user’s device until logging out of the service, after which they are automatically deleted. They enable smooth navigation of the site, remember pages/products viewed by the user, and display the correct content. Permanent cookies remain on the user’s device and are subject to their own privacy policy. Their parameters can be adjusted in the user’s internet browser.

Cookies are mainly used to remember parameters once provided or set by the user, so they do not need to be re-entered each time. They are also used to tailor content presented online to the user, e.g., by displaying relevant ads and images.

Cookies also allow the identification of the user’s browser, ensuring proper display of content. They also collect other informational data, which, in principle, are not considered personal data.

Retargeting
Based on cookies, we use technology that allows us to reach people who visited our website with advertising messages (also on other websites they visit).

Third-party cookies
The cookies we use are primarily intended to optimize the content displayed to the user while using our service. We also cooperate with other companies in their marketing/advertising activities. For this purpose, the browser or other software installed on the user’s device also saves cookies originating from entities conducting such marketing activities. These cookies aim to improve the effectiveness of presenting ads corresponding to the user’s online activity. Third parties provide advertising content to users. Therefore, when visiting our website, cookies from our partners are also stored on the user’s device. This way, information such as viewed or purchased products is collected.

Cookie settings – deletion and blocking
Detailed information about the possibilities and ways of handling cookies is available in the software settings (internet browser). Limiting the use of cookies may affect some functionalities available on the website, or even make it impossible to place an order.

I. GENERAL PROVISIONS

  1. Aqua Solution Sp. z o.o., with its registered office in Kraków, address: ul. Tadeusza Kościuszki 28/LU3, 30-105 Kraków, entered into the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register under number 0000601566, NIP 6793122639, REGON 363711926, share capital PLN 25,000, is the owner of the website and online service www.aquasolution.pl. As the personal data controller of the data collected from users of the website and service, it ensures the security of the personal data provided by users.

  2. Ewa Radłowska, conducting business under the name Ewa Radłowska Alliance in Kraków, address: ul. Tadeusza Kościuszki 28/LU3, 30-105 Kraków, NIP 9930033895, REGON 121551048, is the owner of the online store operating under the domain www.aquasolution.pl. As the personal data controller of the data collected from customers of the "AQUA SOLUTION" store, she ensures the security of the personal data provided by users.

  3. Customer personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), and other applicable personal data protection laws. Personal data means information about an identified or identifiable natural person.

Whenever this document refers to:

  • ADO – it means the personal data controller, which is Ewa Radłowska.

  • Administrator – the owner of the "Aqua Solution" online store and the ADO.

  • User – a natural person who voluntarily provided their personal data in order to use the services of the "Aqua Solution" online store.

  • Policy – this document.

  • Online Store – the "Aqua Solution" online store available at www.aquasolution.pl.

  1. The Administrator takes special care to protect the interests of data subjects, in particular ensuring that the data collected are processed lawfully, fairly, and transparently.

  2. Information contained in system logs may include various data, e.g., IP addresses. The User consents to their use solely for technical purposes and for collecting general statistical information. Such data may be disclosed to entities authorized under the applicable law in cases of violation of the Administrator’s rights, attempted hacking, or other harmful actions.

II. COOKIES

  1. The online store uses cookies, i.e., text files stored on the user’s computer, identifying them as necessary to enable certain operations. Cookies are used to:

    • adapt website content to the user’s preferences and optimize use of the site;

    • collect statistics on how users use websites to improve their structure and content;

    • maintain user sessions after login, so users do not need to re-enter their email and password on each subpage;

    • limit the number of displayed ads, and provide ads tailored to user interests.

  2. The cookies used by the Administrator are safe for the user’s device. They do not allow viruses or malicious software to enter the device.

  3. The Administrator uses two types of cookies:
    a. Session cookies – stored on the user’s device until the browser session ends, then permanently deleted. They do not allow the retrieval of personal or confidential data.
    b. Permanent cookies – stored on the user’s device until deleted by the user. Ending a browser session or turning off the device does not remove them. They also do not allow the retrieval of personal or confidential data.

  4. Users can restrict or disable cookie access to their devices. However, doing so may limit some functionalities of the Online Store.

  5. Internet browsers usually allow cookies by default. Users may change these settings at any time, e.g., to block automatic cookie handling or to be notified each time cookies are placed on their device.

  6. Cookies placed on the user’s device may also be used by advertisers and partners cooperating with the Administrator.

  7. The Administrator informs that restricting the use of cookies may affect some functionalities of the Online Store.

III. PERSONAL DATA

  1. The Administrator ensures that collected data are:

    • processed lawfully, fairly, and transparently;

    • collected for specific, legitimate purposes and not further processed in a way incompatible with those purposes;

    • adequate, relevant, and limited to what is necessary;

    • processed securely, protecting against unlawful or unauthorized processing, accidental loss, destruction, or damage.

  2. The purposes of processing personal data include:

    • conclusion and performance of service agreements (customer accounts);

    • conclusion and performance of sales contracts or reservations;

    • handling complaints;

    • organizing contests;

    • presenting advertisements, offers, or promotions (including newsletters);

    • evaluating and analyzing customer activity for personalized offers;

    • pursuing claims and defending against claims;

    • fulfilling legal obligations (tax, accounting, etc.);

    • communicating with customers.

  3. Providing personal data is voluntary, but failure to provide required data prevents the provision of services. Consent can be withdrawn at any time by contacting biuro@aquasolution.pl or via mail at Alliance Ewa Radłowska, ul. Krasowa 24, 30-376 Kraków.

  4. Data may be shared only for contract performance (e.g., with courier services, legal or accounting providers) or disclosed to authorities under applicable law.

  5. Sharing data with other entities requires the user’s prior consent.

  6. Users have the right to:

    • file a complaint with the President of the Personal Data Protection Office;

    • transfer their data to another controller;

    • access, supplement, or correct their data;

    • request suspension or deletion of data;

    • object to processing.

  7. The primary legal basis for processing personal data is the necessity to perform a contract or take pre-contractual actions at the customer’s request (Art. 6(1)(b) GDPR). Other bases include legal obligations, voluntary consents, and legitimate interests.

  8. Partners of the Administrator may also process personal data in limited scope (e.g., hosting, telecommunications, payment services, shipping, marketing, legal services).

  9. Personal data are stored and secured in accordance with applicable laws (including the Act on the provision of electronic services, relevant regulations, and GDPR).

  10. Personal data are stored as long as required by law or until claims expire.

  11. The Online Store may contain links to other websites. This Policy applies only to the Administrator’s activities.

  12. The Administrator applies technical and organizational measures to protect personal data against unauthorized access, loss, alteration, or destruction.

  13. If the Administrator receives notice of unlawful use of services, they may process the user’s personal data to determine responsibility.
